    Thank you Avinash for explaining the concept of copyright infringement…. Unfortunately, most of us in India have very limited knowledge of such matters.

    On the point of LearnHub monitoring – Since LearnHub will be the obvious target of any law suit (if any) (Please recall the unfortunate MMS case of ebay in India), the onus of monitoring lies with LearnHub.

    I agree to the point that if such infringement is noticed by any user – it should be brought to the notice of LearnHub managers – however any action will still need to be taken by LeanHub.

      Hi

      I would like to add a small clarification – LearnHub’s service agreement is such that users are responsible for the content they bring on to the site. I am not sure how this will play out, in the event of a law suit.

      As an analogy – if some people use mobile phones for planning a robbery, then a law suit can’t be brought over the service provider (such as airtel or hutch) or the company which manufactures the phone (nokia, etc). Similarly, I guess one can’t sue LearnHub if a certain user posts content which one finds objectionable.

      When instances of plagiarism are reported, LearnHub can ask the user to remove the content – this is in sync with the Service Agreement. As you’ve suggested – the lessons can also be deleted forcibly by someone from LearnHub’s team. However, I guess it sets a bad precedent. It’s always better if a user is cautioned and then she/he corrects her/his errors.

      Offensive content/socially unacceptable content/spam – will be removed so that users have a better experience on LearnHub.

      I suggest you go thru’ the lesson on licensing and the Creative Commons community on LearnHub.

      I absolutely agree with you. The mobile phone analogy given by Chandra can not be logically applied here where in most cases the learnhubbers, even very experienced ones, have no/very little/incorrect knowledge about the copyright issues. Many experienced learnhubbers are simply giving reference of the source from where their content is taken, but i guess nobody may be taking the prior permission of such sources to publish their content, which also according to Chandra is not a correct practice. In many cases, like my case, i am getting material from other persons which i post on learnhub. I have absolutely no way of knowing/ascertaining whether the material being posted is a copyrighted material of some original source/creator thereof. It is difficult to track down the original source/creator of the material.

      Such being the situation in more than 90% of the cases, it is expected from learnhub to institute a foolproof and practicable mechanism into place rather than simply expecting the innocent learnhubbers to ensure full compliance. I am not saying that learnhubbers don’t have any responsibility regarding the infringement of copyrights, but that in most cases, people are not fully and properly aware of the legalities. Learnhub should realise the fine difference between an organised and intentional crime and an inadvertent mistake. Because of these problems, I can tell from some instances in the courts that in all such instances, Learnhub will be held solely liable for not ensuring proper surveillance of copyright infringements, notwithstanding a simple one sided clause (that puts full onus of material posted on the learnhub on the learnhub user/publisher of the material on learnhub) in the Service Agreement which is liable to be set aside in the court judgements.

    You make a valid point regarding copyright infringement, however it is for LearnHub to monitor. Common users like me can be of little/no help… Users who create such content on a regular basis should be warned.

    One question: most of the content that I have created for example is rephrased and rewritten with research from various sources on the net. However some phrases of the original content may creep in…. Would you call that an infringement?

    Hi Rahul,

    Discussions with you are getting interesting. Unfortunately I feel that you are very new to this site and possibly do not understand the complete working of the system….

    1. Learn hub is very ‘democratic’ in its approach.

    2. You as a user can ‘vote’ an article ‘up’ or ‘down’ – this will affect the authority of the author.

    3. The system is not perfect and could be modified to enpower the users more.

    4. I stand corrected on my previous comment – ’ the authority system is a small incentive for adding more content and other activities’ However it still is a small incentive – not a very big deal !

    5. Let me suggest you also add some content – possibly in IIT-JEE preparation community (Since you have already cracked that one). It will help you appreciate the amount of effort and research that goes into creating content – even if it seems to be just ‘cut & paste’.

    Hope you will take my suggestions on a positive note!

    Hi Rahul, Although I agree with you to some extent, but don’t you think that the relevance and quality of the content is more important than whether it is copied or not? (It should be attributed, of course!)

    By the way the authority system is just a small incentive for you to put up more and more content.

    Too much hype – ya, you could say that. Maybe I am also taking advantage of it by creating this community:) But I would like to think of it as a lot of ‘positive energy’ and ‘momentum’. And I think this positive momentum is necessary if Obama needs to solve most of the issues he is facing….

    Tiffany – you make a good point – that’s the very aim of this community – to understand Obama better and how he has managed to overcome odds so far and how he really does it! Unfortunately I am finding it difficult to cope up with Obama…

    Motivational Obama:

    Someone puts in a lot of effort and creates a community – it would be unfortunate to loose the creative endeavour of anybody. I would rather suggest ‘auction’ of such ‘inactive’ communities and inviting other community leaders to infuse fresh content into them.
